TERMS AND CONDITIONS, STRUCTURAL SEPARATION, AND COMPREHENSIVE INDEMNITY

Version: Master 35.1 | Last Updated: September 2026

1. Binding Agreement and Electronic Acceptance

By accessing, browsing, or utilizing the ImStaying portals, filling out our digital interfaces, submitting personal data, or interacting with any platforms owned, managed, or operated by ImStaying NPC, the #ImStaying movement, or the IMS political party (collectively referred to as "the Organisation"), you explicitly agree to be bound by these Terms and Conditions. If you do not accept these terms in their entirety, you must immediately cease using this platform.

2. Corporate, Jurisdictional, and Financial Separation

Users are explicitly notified that this web portal serves as an integrated structural gateway for two operationally independent frameworks:

#ImStaying NPC

A registered Public Benefit Organisation (PBO) focused on civic utilities, helpdesk services, and community relief.

IMSTAYING IMS

A registered political party contesting the local government elections.

While these entities share administrative facilities at 158 Rose Avenue, Lenasia, for logistical efficiency, neither framework acts as an agent for, controls, or carries liability for the debts, actions, or statutory obligations of the other.

The civic movement exercises zero political canvassing, and the political platform exercises zero operational control or ownership over public benefit assets.

Universal digital infrastructure and server pipelines are independently funded via transparent commercial structures below statutory thresholds to guarantee total freedom from outside donor cartels.

3. Statutory Independence and Non-Affiliation Notice

The Organisation operates independently of state machinery.

Electoral Commission (IEC) Disclaimer

The Organisation is NOT an official partner, affiliate, subsidiary, or designated agent of the Electoral Commission of South Africa (IEC).

Any reference to municipal ward boundaries, lookup mechanisms, or electoral mapping utilizes open public GIS datasets and is executed solely for geographic routing and civic alignment.

Municipal Disclaimer

The Organisation is entirely independent of the City of Johannesburg Metropolitan Municipality (CoJ) and all state organs.

4. Collection and Processing of Physical Residential Data

You explicitly acknowledge and authorize that the Organisation collects specific, identifiable personal metrics, including your Full Name, WhatsApp Number, Suburb, and Physical Street Address.

This data is gathered to enable localized ward mapping, community network allocation, and real-world municipal infrastructure fault escalation.

By submitting your street address, you grant the Organisation and its designated operational agents the express authority to transmit this information to regional oversight structures, municipal managers, and state utilities including but not limited to City Power, Joburg Water, Johannesburg Roads Agency, and Pikitup for the sole purpose of resolving public service defects.

5. Comprehensive Public Liability Indemnity and Waiver

To the maximum extent permitted by South African law, you hereby explicitly indemnify, defend, and hold harmless the Organisation, its founder (Shireen Ebrahim), its national executives, regional staff, office-bearers, field volunteers, delivery managers, and WhatsApp/social media group moderators against any and all forms of public or private civil litigation, damages, losses, personal injury, regulatory actions, financial disruptions, or punitive claims.

This total waiver of liability extends, without limitation, to:

Municipal Failures

Any operational delays, non-performance, administrative oversights, or absolute failures by third-party municipal authorities or emergency first responders in resolving infrastructure defects, safety issues, or utility outages logged through this framework.

Organic Community Communications

Any defamatory statements, hate speech, unauthorized data sharing, scam linkages, or interpersonal civil disputes arising organically within independent, volunteer-moderated community WhatsApp groups, broadcast networks, or digital hubs.

Community Hero Nominations

Any interpersonal friction, legal objections, or disputes arising from the digital broadcast of individuals nominated for the Community Hero Humanitarian Awards.

The nominating user assumes 100% of the legal burden to secure prior social clearance from the nominee before uploading their identity.

6. Media Upload Safety Standards and Asset Forfeiture

When utilizing our digital file upload engines for CV profiles, municipal fault proofs, or Hero portraits, you are strictly prohibited from submitting assets containing visible South African National Identity Books, smart ID cards, passports, birth certificates, clear vehicle registration license plates, or the unblurred, identifiable faces of minor children under the age of 18.

The Organisation retains the absolute statutory right to summarily delete non-compliant media assets from its databases without prior notice.

7. Termination of Service and Automated Communications Opt-Out

The Organisation reserves the right to restrict access to its digital help desks or sever group communications for any user violating local laws or engaging in disruptive behavior.

You may terminate your communication link at any time.

All automated messaging layers contain explicit instruction commands; replying "STOP" via WhatsApp or emailing dpo@imstaying.co.za will trigger an automated profile freeze.

PROTECTION OF PERSONAL INFORMATION ACT (POPIA) COMPLIANCE POLICY

Version: Master 35.1 | Effective Date: September 2026

1. Introduction and Commitment to Privacy

ImStaying NPC, the #ImStaying movement, and the IMS political party are deeply committed to protecting your privacy.

This policy outlines how we collect, process, safeguard, and retain personal data in strict accordance with the Protection of Personal Information Act, No. 4 of 2013 (POPIA) of South Africa.

This policy applies to all residents of the City of Johannesburg and the broader South African territory interacting with our portal.

2. Air-Gapped Backend Database Cordoning (Anti-Mingling Mandate)

In strict compliance with POPIA conditions for specific purpose limitations, the Organisation enforces a rigid, air-gapped architecture on its shared web and mail server environment.

Personal metrics, contact numbers, and residential street addresses processed via the #ImStaying NPC Civic Hub are stored in completely isolated databanks.

This data cannot and will not be extracted, shared, cross-referenced, or repurposed for political campaign canvassing, party tracking, or electoral marketing campaigns by the IMS political party.

Each processing pipeline is firewalled to preserve total user data sovereignty.

3. Categories of Information Collected and Purpose Specification

We collect and process personal data under specific lawful conditions directly related to the action pathways selected by the user.

Identification Data

Full Names and Surnames used to verify user identity within community frameworks.

Contact & Digital Channels

WhatsApp Numbers used as the primary interface for system updates, local alerts, and free tool distributions.

Geographic & Residential Data

Suburbs and Full Street Addresses used explicitly to determine geographic wards via public GIS datasets and to package formal infrastructure escalation templates for municipal providers.

Employment & Economic Data

Current work status, operational skill sets, and digital CV documents processed solely to match candidates with local employment and graphic service grants.

Special Personal Information (Political Persuasion)

Selection of political donation choices or structural alignment pathways.

This data is collected strictly under Section 26 of POPIA with your explicit, separate confirmation to map democratic support for the IMS political entity.

4. Lawful Processing and Third-Party Data Management

Data Transmission for Escalations

Your physical address and municipal references will be shared with City of Johannesburg oversight officials and utilities when you log infrastructure faults via Section 3.

Third-Party Privacy Controls (Hero Wall Vetting)

To prevent POPIA data violations regarding third parties, all submissions via Section 5 (Recognize a Hero) are treated strictly as an internal request for vetting.

The Organisation will never publish a hero’s contact number publicly, and their name/story will only be added to the Hero Wall after internal validation protocols are completed.

5. Security, Cross-Border Transfer, and Cloud Infrastructure

All data captured through our portal is synchronized and stored within encrypted databases hosted via Google Workspace cloud engines.

The Organisation ensures that all cross-border data transmissions comply with Section 72 of POPIA.

We maintain strict firewalls, role-based access restrictions, and administrative audits to protect information from unauthorized entry, alteration, or deletion.

6. Data Retention and Mandatory Post-Election Purging Lifecycle

In alignment with data minimization principles, the Organisation holds your data for a maximum retention period of three (3) calendar years from your last active digital engagement.

Electoral Data Retention

All Special Personal Information collected specifically for the 4 November 2026 Local Government Elections campaign track will be securely archived post-election.

It will be permanently purged or irreversibly anonymized within the statutory 3-year window unless active ongoing political membership consent is maintained.

7. Your Statutory Rights and Contact Information

Under POPIA, you retain full ownership of your data profile.

You have the right to request access to your records, object to data processing, submit information corrections, or demand the absolute erasure of your files.

All data access requests or compliance objections must be routed directly via email to our designated Data Protection Officer at:
